Important information for ASX Listed Entities

Exposure Draft - Proposed ASX Listing Rule Amendments - Capital Raising Mechanisms in a Disclosure-Based Market

In October 2003, ASX issued an Exposure Draft outlining proposals to amend certain aspects of Chapter 7, with a view to maximising flexibility in the structuring of capital raising mechanisms for ASX listed entities. The original schedule envisaged that the amendments would take effect on 30 January 2004.

Since October, ASX has conducted seminars around Australia discussing the proposals and receiving feedback from a wide range of stakeholders, including the receipt of more than 60 written submissions. While the overall response has been very positive, ASX expects some of the rule amendments to differ from the form originally proposed as a result of this process.

ASX expects the effective date for the proposed Listing Rules will be the end of March 2004, before which time it will announce the final amendments.

Copies of the Exposure Draft are available here

Australian International Financial Reporting Standards (AIFRS) are likely to be adopted for financial year 2005 and it is important that companies commence preparations for these standards now. ASX has prepared some guidelines to assist you in continuing to meet your continuous disclosure obligations as they relate to these standards and their introduction.
