Important information for ASX Listed Entities
Next periodic report due dates
Listed entities are reminded of the due date for the next two periodic reports.
Under
listing rule 17.5 (PDF 129 KB), entities that fail to lodge these reports by
the due date are to be suspended. Although the calendar due date for these two
reports is the same, the suspension date is different.
Quarterly reports - final due date, Friday 30 October 2009
Quarterly cash flow reports for entities that lodge
Appendices 4C,
and quarterly mining activities reports and quarterly cash flow reports in the
form of
Appendix 5B lodged by mining or mining exploration entities, for the quarter
ended 30 September 2009 are due by 31 October 2009. Because 31 October 2009
falls on a Saturday, the due date is moved under
listing rule
19.5 (PDF 148 KB) back to the immediately preceding Business Day,
which is Friday 30 October 2009. Entities that fail to lodge an
Appendix 4C,
a quarterly activities report, or an
Appendix 5B,
by the time Company Announcements Office (CAO) closes on the evening of Friday
30 October 2009 will be suspended from official quotation with effect from the
open of the market on Monday 2 November 2009.
Annual reports - final due date, Monday 2 November 2009
Annual reports for entities with a year ending 30 June for the year ended 30
June 2009 are also due under
listing rule
4.7 (PDF 191 KB). The due date for these annual reports is no later than the
date by which they must be sent to security holders under section 315 of the
Corporations Act.
Because
listing rule 4.7 (PDF 191 KB) adopts the timing requirement of the
Corporations Act in respect of the annual report, the due date, when it
falls on a non-business day, is moved in accordance with the time requirements
of the Corporations Act and not listing rule 19.5.
The due date of 31 October 2009 falls on a Saturday, so the due date for the
annual reports under
listing rule
4.7 (PDF 191 KB) is extended to the immediately following business
day, which is Monday 2 November 2009. Therefore, listed entities will have until
the time that CAO closes on the evening of Monday 2 November 2009 to lodge their
annual reports due under
listing rule
4.7 (PDF 191 KB). Those that have failed to lodge their annual reports by
that time will be suspended from official quotation with effect from the open of
the market on Tuesday 3 November 2009 (Melbourne Cup Day). (Melbourne Cup Day is
not a public holiday or bank holiday in any State other than Victoria, and is a
normal trading day and CAP is open; so it is regarded as a business day for
these purposes, although it is not a "Business Day" for the purposes of equities
settlement.)
Please note that the reminder letters for annual reports show a due date of 30
October 2009 since they are system-generated in accordance with the listing
rules.
