ASX Markets Supervision Education and Research Program

What is the ASX Markets Supervision Education and Research Program (ASXMSERP)?

As a measure to manage potential conflicts of interest, in June 2007 ASX announced that the proceeds of fines and settlements from its Disciplinary Tribunals (less certain expenses in taking matters before the Tribunals), would go towards a research and education program.  The program was established in late 2007 and called the ASX Markets Supervision Education and Research Program.

Mission statement

To raise awareness of and promote compliance with ASX’s supervisory requirements and supervisory issues in ASX's markets.

Terms of reference

To undertake activities which are in the best interests of ASX’s stakeholders and which:

  • raise awareness of ASX supervisory requirements; or
  • improve the ability of market participants to comply with ASX’s supervisory requirements; or
  • educate the market on trends and issues in supervision; or
  • contribute to a better understanding of supervisory issues and trends in ASX's markets and globally; or
  • contribute to better compliance and knowledge culture within ASX’s stakeholder groups.

Examples of educational activities ASX currently conducts within the ambit of its "core" supervisory activities, and therefore activities which would not be funded from this program, include the following:

  • Rule amendments and Guidance Notes;
  • companies updates; and
  • compliance newsletters.

Coming up

  • SDIA Market Manipulation and Prohibited Conduct Workshops - June and July 2009 in Sydney, Melbourne and Perth.  A set of workshops on market manipulation, insider trading and other prohibited conduct.  Audience: ASX Participants, SFE Participants, SDIA members.
  • ASX and ASIC Financial Reporting Update Lunchtime Seminar - 2 June 2009 in Brisbane.  An outline of respective financial reporting obligations and an update on recent developments and issues.  Audience: Financial reporting staff of listed companies and financial/accounting/audit advisors to listed companies.
  • The Listed Company Director Course - 29 May 2009: QLD; 25 June 2009: VIC; 16 July 2009: NSW; and 9 September 2009.  Duties and responsibilities of directors within the listed company environment.  Obligations of the listing rules, consequences of non-compliance.  Audience: new and existing board members of listed companies.   • JORC Code Seminar - 1 June 2009 in Melbourne, 2 June 2009 in Sydney and 3 June 2009 in Brisbane.  An update on the JORC Code by ASX, ASIC and JORC.  Audience: ASX Listed companies, ASX Participants, advisory community.  Information about last year's JORC seminars can be accessed on the "Previous events" (Issuers) pages of the website.
  • CCP Continuous Disclosure workshop - 5 June 2009 in Perth.  The continuous disclosure obligations of listed entities.  Audience: Company secretaries of listed companies, other employees of listed companies who have ASX-related obligations and responsibilities.
  • ASX Surveillance Seminar - date to be advised, to be held in Melbourne and Perth.  Demonstration of ASX surveillance systems, how continuous disclosure rules and trading rules are monitored and enforced.  Audience: ASX Listed companies, and their advisors.  Information about last year's Surveillance seminars can be accessed on the "Previous events" (Issuers) pages of the website.
  • Capital Monitoring Workshop - date(s) and location(s) to be advised (2nd half 2009).  Obligations and regulations in the capital monitoring regime of ASX participants.  Audience: ASX participants who have capital monitoring responsibilities - people who prepare returns, CFO’s, compliance staff, responsible executives.
  • Compliance Course - date(s) and location(s) to be advised (2nd half 2009).  Overview of the Compliance and Risk framework, internal control systems and other techniques which mitigate, control and resolve risks under the ASX Operating Rules.  Audience: Compliance Officers, Risk Officers, Responsible Executives, Team Leaders.
